Terms of Service

1. Acceptance of Terms

Welcome to fodia. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Naim Dridi Podadera ("fodia," "we," "us," or "our"), the developer and operator of the fodia mobile application and website as a personal project.

By downloading, installing, accessing, or using fodia, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use fodia.

2. Description of Service

fodia is a minimalist food and digestive symptom diary designed to help you track meals and symptoms and spot potential patterns (e.g. for a low-FODMAP elimination approach). Key features include:

• Local Encrypted Storage: Meals, symptoms, and notes are stored locally on your device using SQLCipher encryption.
• AI Meal Analysis (Premium): On request, fodia can estimate nutrition and flag possible FODMAP trigger ingredients for a meal you log, using text and/or a photo you provide.
• AI Insight Summaries (Premium): On request, fodia can narrate your own pre-computed daily, weekly, or monthly statistics in plain language.
• Clinical CSV Export: You can export your diary as an unencrypted CSV file intended for review with a doctor or dietitian.
• Encrypted Backup & Restore: You can export your data as an encrypted JSON file and import it later to restore your diary.
• Reminders: Optional local and push notifications to remind you to log meals.
• Anonymous Usage: The app uses Firebase Anonymous Authentication; no email or registration is required for core features. You may optionally link an email, Google, or Apple account.

fodia is provided "as is" and may be updated, modified, or discontinued at any time. We will make reasonable efforts to notify users of significant changes.

3. Eligibility & Account Requirements

To use fodia, you must:

• Be at least 18 years of age. If you are under 18, you must obtain permission from a parent or legal guardian before using the app.
• Have the legal capacity to enter into these Terms.
• Agree to comply with all applicable laws and regulations in your jurisdiction.

fodia uses anonymous authentication by default. You are responsible for safeguarding your device and any backup encryption keys. We are not liable for unauthorized access resulting from your failure to secure your device.

4. User Obligations & Acceptable Use

You agree to use fodia responsibly and in compliance with these Terms. Specifically, you agree not to:

• Use the app for any illegal, harmful, or fraudulent purpose.
• Attempt to reverse engineer, decompile, or disassemble the app or its underlying code.
• Use automated scripts, bots, or other tools to interact with the app or our Cloud Functions in ways that violate their intended functionality.
• Submit content to our servers (e.g. via support emails) that is defamatory, obscene, threatening, discriminatory, or violates the rights of others.
• Interfere with or disrupt the operation of fodia's servers, networks, or services.
• Impersonate any person or entity, or falsely claim affiliation with fodia.
• Attempt to bypass usage limits or app-integrity checks (e.g. Firebase App Check).

Violation of these obligations may result in suspension or termination of your access to fodia.

5. Intellectual Property & Ownership

5.1 Your Content

You retain full ownership of all diary entries, meal photos, notes, and other content you create in fodia ("Your Content"). Your Content remains your property, and we do not claim any ownership rights over it.

5.2 License to Use Your Content

To provide the Service, you grant fodia a limited, non-exclusive, royalty-free license to:

• Store Your Content locally on your device (encrypted).
• Process the specific meal text/photo or pre-aggregated statistics you submit to generate AI analyses or insight summaries (only when you request them).

This license is solely for the purpose of operating and improving fodia. We do not use Your Content for advertising, marketing, or any other purpose. See our Privacy Policy for details on how we handle data.

5.3 Our Content

fodia, including its design, user interface, code, logos, graphics, and original text (excluding Your Content), is owned by Naim Dridi Podadera and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. You may not copy, distribute, modify, or create derivative works from fodia without our prior written consent.

6. AI-Generated Content & Medical Disclaimer

fodia uses artificial intelligence to estimate meal nutrition, flag possible FODMAP trigger ingredients, and narrate your own logged statistics. Important disclaimers:

• Not a Medical Device: fodia does not diagnose, treat, cure, or prevent any disease or medical condition, including IBS or FODMAP intolerances.
• Not Medical, Dietary, or Therapeutic Advice: fodia is not a substitute for professional medical care, registered dietitian advice, or nutritional counseling. Always consult a qualified healthcare professional before making dietary changes, especially for an elimination diet.
• No Guarantee of Accuracy: Nutrition estimates, trigger flags, and AI narrations are approximate and may be inaccurate, incomplete, or contextually inappropriate. Use your own judgment when interpreting AI-generated content.
• Not Legal or Financial Advice: Insights do not constitute legal, financial, or professional advice of any kind.
• Photo Analysis: When you attach a meal photo for analysis, it is downscaled, transmitted securely to our server, and forwarded to OpenAI for processing; it is not stored on our servers afterwards. Avoid photographing anything containing sensitive personal information.
• Emergency Situations: If you are experiencing a medical emergency or severe symptoms, contact a qualified healthcare professional or emergency services immediately.

By using these optional AI features, you acknowledge these limitations and agree that fodia is not liable for any decisions you make based on AI-generated content.

7. Data & Export Responsibility

fodia provides encrypted backup/restore and unencrypted clinical CSV export tools so that you remain in control of your own data. You are solely responsible for:

• Keeping your own backups; we do not retain a copy of your diary on our servers.
• Any content you choose to include when sharing a CSV export (e.g. with a healthcare provider) — this file is unencrypted by design so it can be opened by clinical software.
• Safeguarding any password or key you use to protect an encrypted backup file.

8. Payments, Subscriptions & In-App Purchases

8.1 Subscription Overview

fodia offers a free tier for core diary functionality, as well as an optional paid subscription tier ("fodia Premium") that unlocks all AI-powered features. By subscribing to or purchasing fodia Premium, you agree to the pricing and billing terms presented to you in the app and on the platform store.

8.2 Subscription Plans & Lifetime Purchase

fodia offers the following purchase options, billed and processed exclusively through Apple App Store or Google Play Store:

• Weekly Subscription - Billed weekly
• Monthly Subscription - Billed monthly
• Yearly Subscription - Billed annually (may include a free trial)
• Lifetime Purchase - One-time upfront payment for permanent access

Pricing is displayed in your local currency at the time of purchase in the app and may vary by country or territory.

8.3 Free vs. Premium Features

Free Features: Core diary functionality is completely free: logging meals, symptoms, and notes; local encrypted storage (SQLCipher); encrypted backup and restore; and unencrypted clinical CSV export. You will never be required to pay to log your food or access your diary data.

Premium Features: All features powered by artificial intelligence — including AI meal analysis, FODMAP trigger detection, nutritional estimation, daily AI digests, and monthly/weekly AI insight reports — are premium features that require an active fodia Premium subscription or Lifetime purchase.

8.4 Free Trial Terms

If a subscription plan includes a free trial:

• You will not be charged during the free trial period.
• You have full access to all fodia Premium features during the trial.
• You can cancel anytime during the trial without being charged.
• Important: To avoid being charged, you must cancel at least 24 hours before the end of the free trial period.
• If you do not cancel before the trial ends, your subscription will automatically convert to a paid recurring subscription and your Apple ID or Google Play account will be charged the applicable price.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.

8.5 Auto-Renewal & Billing

Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan. All payments and renewals are handled exclusively by Apple App Store or Google Play Store billing systems; we never collect or handle your payment details directly.

8.6 Managing & Cancelling Subscriptions

You can manage and cancel your subscriptions at any time through your device account settings or via the link in the fodia app Settings:

iOS (Apple):

1. Open the Settings app on your iPhone or iPad
2. Tap your name / Apple ID at the top
3. Tap "Subscriptions"
4. Select "fodia" from the list
5. Tap "Cancel Subscription"

Android (Google Play):

1. Open the Google Play Store app
2. Tap your profile icon in the top right corner
3. Tap "Payments & subscriptions" → "Subscriptions"
4. Select "fodia" from the list
5. Tap "Cancel subscription"

8.7 Refunds

All purchases and refunds are governed by Apple's and Google's respective store refund policies. We do not have the ability to issue refunds directly. To request a refund:

• Apple: Visit reportaproblem.apple.com or contact Apple Support.
• Google Play: Visit play.google.com/store/account/subscriptions or contact Google Play Support.

8.8 Price Changes

We reserve the right to change subscription prices in accordance with platform rules. If the price of your subscription changes, you will be notified in advance and given the option to accept the new price or cancel your subscription.

9. Termination & Suspension

9.1 Termination by You

You may stop using fodia at any time by uninstalling the app from your device, or by deleting your account in Settings. Export a backup first if you want to keep your data — see Section 8.3 of our Privacy Policy.

9.2 Termination by fodia

We reserve the right to suspend or terminate your access to fodia at any time, without prior notice, if:

• You violate these Terms or our Privacy Policy.
• Your use of the app poses a security or legal risk.
• We are required to do so by law or court order.

Because fodia uses anonymous authentication, termination typically involves blocking your anonymous UID from accessing our Cloud Functions (AI features, notifications). Your local diary on your device will remain accessible unless you choose to delete it.

9.3 Effect of Termination

Upon termination:

• Your license to use fodia is revoked.
• We may delete any server-side data associated with your anonymous UID (account record, device registrations, crash reports) within a reasonable timeframe.
• Sections of these Terms that by their nature should survive (e.g., intellectual property, disclaimers, limitations of liability) will remain in effect.

10. Disclaimer of Warranties

fodia is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the app will be uninterrupted, error-free, secure, or free of viruses.
• Warranties regarding the accuracy, reliability, or completeness of AI-generated content or any other feature.

We do not guarantee that fodia will meet your specific requirements or that any defects will be corrected. Your use of the app is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, Naim Dridi Podadera (the developer) and any affiliated contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of fodia, including but not limited to:

• Loss of data, profits, or business opportunities.
• Health outcomes or dietary decisions made in reliance on AI-generated content.
• Unauthorized access to or alteration of your device or data.
• Errors, bugs, or security vulnerabilities in the app.

In jurisdictions that do not allow the exclusion or limitation of liability, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount you paid to use fodia in the 12 months preceding the claim (which, while fodia is free, is zero).

12. Indemnification

You agree to indemnify, defend, and hold harmless Naim Dridi Podadera and any affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of fodia in violation of these Terms.
• Your violation of any third-party rights, including intellectual property or privacy rights.
• Your Content, including any harm caused by content you create or share.

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

13. Governing Law & Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with applicable international law and the laws of your jurisdiction of residence, without regard to conflict of law principles. As this is a personal project, specific jurisdiction will be determined based on your location and applicable consumer protection laws.

13.2 Dispute Resolution

Any dispute arising from or relating to these Terms or your use of fodia shall be resolved as follows:

1. Informal Resolution: Before initiating formal proceedings, you agree to contact us at appfodia@gmail.com to attempt to resolve the dispute informally.
2. Mediation: If informal resolution fails, both parties agree to participate in non-binding mediation.
3. Binding Arbitration or Court: If mediation fails, disputes may be resolved through binding arbitration or in the courts of your jurisdiction, as appropriate under local law. You agree to submit to the exclusive jurisdiction of these courts.

13.3 Class Action Waiver

You agree to resolve disputes on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration against fodia.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or app features. When we make significant changes:

• We will update the "Last Updated" date at the top of this page.
• We will notify you via an in-app message or email (if you have provided contact information).
• If you continue to use fodia after the updated Terms take effect, you agree to be bound by the new Terms.

If you do not agree to the updated Terms, you must stop using fodia.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and fodia regarding your use of the app, and supersede any prior agreements or understandings, whether written or oral.

18. Third-Party Services

fodia integrates with third-party services, including:

• Firebase (Google): For authentication, app integrity checks, crash reporting, remote configuration, and push notification delivery. Firebase Terms.
• OpenAI: For generating meal analysis and AI insight summaries. Data is transmitted securely and processed according to OpenAI's policies. See our Privacy Policy for details.
• Apple App Store / Google Play Store / RevenueCat: For app distribution, in-app purchase and subscription processing, and receipt validation. You are subject to Apple's and Google's respective terms of service for purchases and platform accounts.

We are not responsible for the practices or policies of third-party services. You use them at your own risk.

19. Export & Import Compliance

fodia uses encryption technology. You agree to comply with all applicable export control laws and regulations when using the app. You may not use fodia in any country or jurisdiction where such use is prohibited by law.

20. Feedback & Suggestions

If you submit feedback, feature requests, or suggestions to fodia (via email), you grant us a perpetual, worldwide, royalty-free license to use, incorporate, and commercialize your feedback without any obligation to compensate you or provide attribution.

We welcome your input and will use it solely to improve the app.

21. Summary of Key Points

• You must be 18+ (or have parental consent) to use fodia.
• You own your diary entries; we only process them to provide the service.
• fodia is not a medical device. AI-generated nutrition estimates, trigger flags, and insight summaries are informational only, never professional advice.
